Proof of Service: Affidavit of Service

This template Affidavit of Service may be used in New Jersey Superior Court as proof of service pursuant to N.J. Ct. R. 1:5-3. It includes practical guidance, drafting notes, and optional clauses. All papers as discussed in to N.J. Ct. R. 1:5-1 (orders, judgments, pleadings subsequent to the original complaint, written motions (not made ex parte), briefs, appendices, petitions, and other papers except a judgment signed by the clerk) which are filed with the court, require proof of service to be filed concurrently. N.J. Ct. R. 1:5-3. Failure to supply proof of service, however, will not invalidate proper service and the court may allow it to be provided at a later time. N.J. Ct. R. 1:5-3. Proof of service is generally made by either: • An affidavit of the person making service • A certification of service appended to the paper to be filed and signed by the attorney for the party making service N.J.
